Feb. 6, 2015 B.J. 1104 posts | PITCHER'S MANDATED MINIMUM SAFETY EQUIPMENT STAFF...the pitchers safety rule has been reworded again....(6.17 • PITCHER'S MANDATED MINIMUM SAFETY EQUIPMENT...PITCHERS SHALL WEAR A PROTECTIVE FACE MASK WHILE PITCHING and must wear the mask consistent with the manufacturer’s intended usage of their product.) My question is why do you use the word MANDATED and in the rule say that a pitcher SHALL wear a face mask while pitching....then in a follow up rule (6.17(1) • RELEASE (INJURY TO PLAYER) By electing not to wear the recommended safety equipment the pitcher waives any and all claims)....this states that the pitcher can elect not to wear a mask...To me the definition of MANDATE and SHAll is that you must wear the mask or you cant pitch??? |
Feb. 6, 2015 Robo2 238 posts | I have no problem with this wording. Mandated unless one provides written authorization to void any responsibility. I pitch and think anyone that signs off on not wearing mask is foolish. |
Feb. 8, 2015 SSUSA Staff 3460 posts | B.J. - Please carefully re-read the provisions of Rulebook §6.17 and §6.17(1) ... MANDATED equipment is the face mask ... The words "mandated" and "shall" are used in the same context ... RECOMMENDED equipment includes a helmet, chest/heart protection and shin guards ... Pitchers are required to wear only the mandated equipment (the face mask) ... Pitchers who elect not to wear the recommended equipment waive any liability claims for potential injuries ... There is NO wording that allows a pitcher to elect to pitch without the face mask ... This years simple wording change ("...and must wear the mask consistent with the manufacturer’s intended usage of their product...") was added to clarify the obvious ... On at least two occasions this past year, players asserted that they were compliant with Rulebook §6.17, even though one of them was wearing the mask to protect the back of his head and the other to protect the elbow of his glove arm! ... Yes, they both tried (unsuccessfully) to make that argument with the field director, requiring the Rules Committee to add the new language ... |
